This Affiliate Agreement (“Agreement”) is between AffYogi (“we”, “us”) and the person or business joining the AffYogi affiliate program (“Affiliate”, “you”). By applying to or participating in the program, you agree to this Agreement.
1. The Program
As an approved Affiliate, you may promote AffYogi courses using the unique tracking link or code we provide, and earn a commission on qualifying sales made through it. We may accept or reject any application at our discretion.
2. Becoming an Affiliate
- You must be at least 18 years old and able to enter into a binding agreement.
- You must give us accurate information and keep it up to date.
- You are responsible for keeping your affiliate link and account details secure.
3. Commissions
- You earn a commission on a qualifying sale when a new customer buys a course through your tracked link or code. The commission rate and tracking period are those communicated to you when you are approved, or shown in your affiliate dashboard if one is provided.
- A sale qualifies only once payment is successfully received and the course purchase is not refunded, cancelled or charged back.
- Commissions on refunded sales are cancelled, and any commission already paid on a sale that is later refunded may be deducted from future payouts.
- Self-referrals, meaning purchases you make for yourself through your own link, do not earn commission.
4. Payouts
Approved commissions are paid after the 7-day refund period for the sale has passed, using the payout method agreed with you. You are responsible for any taxes on your earnings, and we may deduct tax at source where Indian law requires it.
5. How You May Promote
- Promote AffYogi honestly and in line with the information on our website.
- Clearly disclose that you are an affiliate, for example “I may earn a commission if you buy through my link”, wherever you share your link.
- Follow the advertising rules of each platform you use, as well as applicable laws and guidelines, including advertising standards in India.
6. Prohibited Activities
- Making false, misleading or exaggerated claims, including income guarantees or fake testimonials.
- Spam, unsolicited bulk messages or any form of misleading outreach.
- Bidding on our brand name, domain or close variations in paid search ads without our written permission.
- Cookie stuffing, forced clicks, hidden redirects or any attempt to artificially generate tracked clicks or sales.
- Using fraudulent, stolen or fake orders, or buying through your own link to earn commission.
- Creating websites, pages or ads that look like they are operated by AffYogi, or that imitate our brand.
- Promoting on websites with illegal, hateful or adult content.
If we find a violation, we may withhold or cancel commissions and remove you from the program without notice.
7. Use of Our Brand
You may use the name “AffYogi” and approved promotional material solely to promote our courses under this Agreement. You may not modify our logos or imply that you are an employee, agent or official representative of AffYogi.
8. Independent Relationship
You are an independent promoter. Nothing in this Agreement creates an employment, partnership, joint venture or agency relationship between you and AffYogi.
9. Term and Termination
This Agreement continues until ended by either party. You may leave the program at any time by emailing us. We may suspend or end your participation at any time, and may change the program, commission rates or this Agreement by posting an updated version or notifying you. Commissions properly earned before termination and not subject to fraud or breach will still be paid.
10. Disclaimer and Limitation of Liability
We do not guarantee any level of traffic, sales or earnings from the program. The program is provided “as is”, and, to the fullest extent permitted by law, our total liability to you under this Agreement is limited to the unpaid commissions that you have properly earned.
11. Governing Law
This Agreement is governed by the laws of India, and any dispute is subject to the exclusive jurisdiction of the courts in India.
